Arbitration

When a dispute arises there are other methods that can be used to attempt to resolve it without costly court proceedings.

What is arbitration?

Arbitration is commonly used in building or construction disputes, but can be used in many other types of disputes. Many contracts require disputes to be resolved by arbitration. Parties can also agree to refer a dispute to arbitration once a dispute has arisen.

Arbitration can often be arranged quickly, and usually costs less than dealing with a dispute at court.

Arbitration is binding on parties and an arbitrators decision can be enforced via the courts if need be.

Who is an arbitrator?

An arbitrator is an independent person, often a lawyer or other professional such as an accountant or chartered surveyor who is either chosen by the parties appointed in accordance with the terms of the contract between the parties.
