Winding up Petitions

If you are owed money by a company, or if your company is insolvent it may be a last resort to wind up or liquidate a company but sometimes this is a necessary action. Winding up petitions can facilitate the recovery of debts owed by a limited company. 

If you are owed money

Our insolvency legal team can act for you (if you are owed more that £750 by a company and the debt is not disputed) to help you wind up or liquidate the company. 

If you're company is insolvent

We can also help if you are a director of your own company and it is insolvent. You are under a duty to take every step to minimise the loss to creditors and if you don’t do this, you may be personally liable to contribute towards the debts of the Company.

As it’s important to cease trading if you know or ought to know that the company is unable to avoid insolvent liquidation, the presentation of a winding up petition is a cost effective alternative to creditors’ voluntary liquidation.  If the shareholders and directors agree we can issue a petition to wind up the company and put it into liquidation.

Statutory Demands 

Our insolvency specialists can advise your company if a creditor serves you with a Statutory Demand (sometimes abbreviated to Stat Demand). The company must respond quickly to avoid a winding up petition being issued.

We can also arrange to serve a Statutory Demand on a company if it owes you money.
