A Lasting Power of Attorney is a document which allows you to appoint someone you trust to look after your affairs in the event that you are not able to do so yourself due to physical or mental incapacity.
Lasting Powers of Attorney replaced Enduring Powers of Attorney in October 2007 as it was felt that Enduring Powers of Attorney were open to abuse. All Enduring Powers of Attorney made before that date will remain valid.
The new Lasting Power of Attorney provides greater scope to specify your wishes in the event of incapacity as it allows you to make a Power of Attorney relating to not only Property and Affairs, as before, but Personal Welfare also.
The new Lasting Powers of Attorney are considerably more complex than the former Enduring Power of Attorney. Given this, it is now more important than ever to take specialist legal advice to ensure that your Lasting Power of Attorney is validly executed and achieves your aims.
