Guidance on Running Employee Investigations in the Public Sector

Against the backdrop of an upturn in reported fraud and economic crime in the public sector, law firm Actons has launched a guidance campaign for public sector HR and Legal teams.

This was confirmed in a report which stated that 52% of public sector organisations experienced economic crime in the last 12 months.

Actons employee investigations practice is headed by former Wragge & Co employment and investigations lawyer Nic Elliott, who specialises in running and advising on employee investigations in both the public and private sectors.

The “Take a closer look” campaign includes hints and tips for managers tasked with running employee investigations – they include issues such as preserving the evidence, not prejudging any decisions, presenting evidence not opinions, ensuring independence and the importance of keeping an open mind.

Nic, who both leads and provides in-house training on employee investigations in the public sector said: “In an ever increasing regulatory environment and one that put the public sector under more scrutiny than ever before, maintaining independence in an internal investigation is more critical than ever.

“Having been involved in a wide range of employee investigations over the last 10 years, our practice is one of the very few that actually carries out these investigations as well as advising on running them.”

Over the last 10 years, Nic has been involved in employee investigations for Derby City Council, Isle of Wight Council, Suffolk County Council, Doncaster Metropolitan Borough Council and the London Borough of Newham.
