
Mandy is a Director with Actons having joined the firm in 1993. She has extensive experience in Private Client Wealth Planning and heads our Probate, Estate Planning, Trusts and Court of Protection team.
Mandy’s clients span a broad range of successful professional and entrepreneurial individuals, trustees, families, and landowners. She gains an in-depth understanding of clients personal tax needs so that she can help them mitigate their exposure to tax both during their own lives and for future generations.
Trusts
Mandy provides specialist and client specific legal advice to both private and business clients on setting-up trusts tailored to their needs. She ensures that clients are confident that their hard won assets are held in a safe environment and that her carefully tailored advice maximises the associated benefits and all of the implications and opportunities using trusts.
Trusts can be used to hold and protect assets for a wide variety of reasons and they are not just for tax and asset protection. For private individuals, trusts can shelter long term assets ensuring family, as opposed to individual, ownership. With family businesses and estates trusts can be used to enable the family to maintain financial benefits while trustees have legal ownership. They can also be used as devices to protect vulnerable family members.
Wills and Estate Planning
Mandy provides expert advice on all aspects of wills and succession planning providing clear guidance on lifetime gifts and inter-vivos and post-mortem estate plans. She works hard to ensure that gift, estate, taxation of inter-generational transfers, wealth taxes and other forms of capital tax are minimized.
By listening and working closely with clients their wants and needs are identified so as to ensure that their estates are transferred fully intact and exactly as they want. Clients are encouraged to forward plan and arrange their affairs so as to protect their assets, including businesses and properties. Her extensive experience in this area ensures that clients and their families are protected and advised about the management and protection of their wealth so that assets pass to their loved ones in the most cost effective and tax efficient way.
With her clear advice and assistance on the administration of estates, post mortem estates are completed in a cost-effective and practical way ensuring that estates are distributed efficiently and as intended with as little tax cost as possible. Where necessary Mandy advises on the use of Deeds of Variation within two years of death so as to enable family beneficiaries to re arrange an estate to alter the distribution in a more tax efficient manner.
Powers of Attorney and Court of Protection
Mandy is able to advise clients about the impact of the Mental Capacity Act 2005 and how it provided a means for people without mental capacity to choose someone to manage both their finances and property and also to make health and welfare decisions on their behalf through a Lasting Power of Attorney (LPA). She also advises on Enduring Powers of Attorney (EPAs) made before October 2007 which if signed by both the donor of the Power and the Attorney/s before 1 October 2007 remain valid whether or not it has been registered at the Court of Protection.
Deputies
Where clients or members of their family lack capacity Mandy is able to help them get orders from the Court of Protection appointing a deputy to make ongoing decisions relating to finances or personal welfare on behalf of those who lack capacity.
