Grounds for Divorce

In order to get divorced you must have been married for one year and there are residence or domicile requirements. You must show that your marriage has broken down and is beyond repair. To do this you must be able to show that one of the following five grounds for divorce exists:

  • Adultery –  your spouse has had sexual relations with another person
  • Unreasonable behaviour – your spouse has behaved in a way that you cannot be reasonably expected to live with
  • Separation with consent – if your spouse agrees to the divorce you must live separately for two years
  • Separation without consent – if your spouse does not agree to the divorce then you must live separately for five years
  • Desertion -  your spouse must have deserted you for two years. This ground is rarely used as it is difficult to prove
