Transfer of Equity

Our experienced property team can assist you with transferring the equity from your property and will help take the hassle out of the process whilst offering protection for your finances.

The equity in a property is the difference between the value of the property and what is owed on any mortgages or charges that are held on the property.

A transfer of equity is where one of a number of owners of the land transfers their equity to another person. For example a husband and wife may own a property jointly and decide to transfer the equity to the wife alone.

You may wish to transfer the equity in your property for a number of reasons, including:

  • Divorce or separation
  • Marriage
  • Tax planning
  • Change to financial shares

Our property team will get official copies of the property’s title deeds from the Land Registry and prepare the transfer deed in readiness for the transfer of equity. If you have a mortgage or charge on the property we will inform the mortgage provider or charge holder of the changes. If the transfer includes a new co-owner, we will discuss whether you need a Trust Deed which will document the proportions in which the property is held and ensure that everyone interests are adequately protected.

Stamp Duty Land Tax is payable in situations where the transfer is sold or gifted but you may be exempt from paying this tax if the transfer is ordered by the court for example after divorce.  We will advise you whether Stamp Duty Land Tax will need to be paid and can assist you with this process.
