Issue
A commercial property landlord had a tenant who had not paid rent. Unfortunately and somewhat unusually, a formal commercial property lease had never been completed.
How we helped
Due to the lack of a lease and a specific ‘express forfeiture’ clause, the commercial property landlord was unable to simply retake possession of the property. However, we were able to obtain a possession order via the County Court.
The result
We recovered possession of the commercial property for the landlord and were able to advise on the options for recovering the rent arrears.
