How to avoid business disputes

The possibility of facing a claim or a dispute is an unfortunate fact of life for any business.

Resolving disputes is about recognising when a dispute has arisen and there are a number of simple steps that can be taken to avoid conflict.

  • Planning ahead and managing the risks
  • Understanding the client’s or customer’s objectives
  • Set out points of dispute and disclose documents in support of your position at an early stage to enable both parties to understand each other’s respective arguments
  • Regular assessment of progress and costs
  • Keeping detailed records which can help to resolve a dispute
  • Raise concerns over any shortage of information or evidence believed to be an obstacle to successful Alternative Dispute Resolution (ADR), together with consideration of how that shortage might be overcome
  • Do not reject ADR outright in case one method might still be worth pursuing even if others are not.
