An 8 year old boy has broken his leg on a ride at Twin Lakes theme park in Leicestershire, East Midlands.

The boy was at the theme park in celebration of his 8th birthday.  He was on a spinning barrel ride with his parents when his shoelace became tangled in a bolt.  He was in a lot of pain and later learned that he had broken his leg. The boy went to hospital and was in a full cast for 8 weeks.

Investigations were made into the ride by the Health and Safety Executive who found that the bolt was protruding from the base. This was poorly covered up with adhesive tape by employees of the theme park.

The park owner accepted fault and liability for the child’s injury. The child received an award of £13,000 for the pain, loss and amenities he suffered.

Theme parks have a duty of care to ensure rides are wholly safe for public use.  Significant risks are apparent as theme parks hold a lot of moving machinery.  Maintenance and inspection must be carried out regularly and at a high standard by the theme park employees.
